Call to Order

Chairman Ward called the meeting to order at 6:03pm and led all present in the Pledge of Allegiance.

Agenda Review

Chairman Ward informed the board of several agenda changes which reflected updates on applications that would not be acted upon at this meeting.

Adoption of Minutes

Ms Carey moved and Mr Derouchie seconded the motion to adopt the minutes of the meeting held Monday, December 15, 2008 as submitted. All ayes, motion carries.

Continued Public Hearing - 117 Hiawatha Trail

Chairman Ward informed the board that Margaret Turk, applicant for a front yard setback variance at 117 Hiawatha Trail, is seeking permission to construct an addition to her home that would encroach an easement that is owned by Onondaga County.

Until this issue is resolved, this application remains adjourned.

Continued Public Hearing – 401-403 First Street

Chairman Ward informed the board that JGB Properties has withdrawn their application for a variance regarding their property on 401-403 First Street. The recent granting of site plan approval by the Village of Liverpool Planning Board has eliminated their need for the variance they applied for.

Public Hearing - 704 Fourth Street

Chairman Ward opened the public hearing on the application of Peter Osborne, seeking a variance to §136-16 C [2] & [4] to permit the construction of a detached garage at a property located at 704 Fourth Street, designated as Tax Map # 006.-03-11.0,

The applicant provided receipts from certified mailings sent out in compliance with Section 136-127 C (3) of the code of the Village of Liverpool.

Following the presentation by Mr Osborne, Chairman Ward coordinated the Type II Negative SEQR determination, completed a short form EAF, examined the 5 criteria of proof, and the opened the floor to commentary in regard to this project.

No neighboring property owners were present to express remarks for or against the project. One property owner who received a notice via certified mail came to view the project file in the Clerk’s office on Friday, February 27th, and offered positive comments in support of it.

After presenting the applicant with detailed design standards for willowsheds, and noting how it would be an appropriate design for an accessory structure used for the parking of vehicles and for storage, Mr Romano moved and Ms Carey seconded the motion to grant the variance as requested. All ayes, motion carries.

Because the project involves the construction of a garage over 150 Sq Ft. in area, the applicant must be granted a special permit by the Planning Board before moving forward to complete the permit process.

[This application was before the Planning Board at their meeting held immediately following this ZBA meeting]

Mr Romano moved and Ms Carey seconded the motion to adjourn. All ayes, motion carries. The meeting was adjourned at 6:15pm.
