Call to Order

Chairman Ward called the meeting to order at 6:00pm and led all present in the Pledge of Allegiance.

 

Adoption of Minutes

Ms Carey moved and Mr Herrgesell seconded the motion to adopt the minutes of the meeting held Monday, September 24, 2007 as submitted. All ayes, motion carries.

 

Continued Public Hearing – 704 Fourth Street

The public hearing on the application of Peter Osborne to permit the construction of a garage structure located at 704 Fourth Street continues open and, at the request of the applicant, will not be examined by the board until re-design processes are complete.

 

Adjournment of Public Hearing – 318 Oswego Street

Chairman Ward informed the Board that, at the request of Attorney Steven Primo, the application of David Stott in regard to 318 Oswego Street has been adjourned.

 

Continued Public Hearing – 117 Second Street

Chairman Ward addressed the open public hearing on the application of John Gormel, seeking a variance to §136-71 D (1) (f) of the code of the Village of Liverpool to permit the continued use of a 32.5 sq ft (per side) ground sign that stands 12.5’ tall on a parcel located at 117 Second Street, designated as Tax Map # 004.-02-01.0.

In the weeks following the opening of the public hearing, it was discovered that an area variance was granted for this sign many years ago, by way of the ZBA appeal of “DeWitt Bagelry” under the name of owner Virginia Adornato.

Mr Gormel’s application was consequently deemed unnecessary by the Code Enforcement Officer.

Mr Romano expressed concern that the sign does not contain the word “parking” and is therefore not being used to identify designated parking. He considers current signage to be merely advertising for “The Retreat”. This assessment is to be forwarded to the Planning Board for consideration in their site plan review of this parcel.

Ms Carey moved and Mr DeRouchie seconded the motion to close the public hearing.

All ayes, motion carries.

 

Public Hearing – 105 Brow Street

Chairman Ward opened the public hearing on the application of Clifford and Sue Wagner for a variance to §136-18 B of the code of the Village of Liverpool, allowing a 2-family home to be converted to a 3-family at a property located at 105 Brow Street, designated as Tax Map # 004.-04-06.0.

Following the presentation by the applicant, Chairman Ward coordinated the SEQR determination and the presentation of both verbal and written commentary in regard to this project. Anthony Lavalle, 101 Tulip Street, provided an information packet to the Board, which expressed his concerns in written form. Said packet is filed with the application, as a part of the real property record for this parcel.

Because this parcel is located within 500’ of Onondaga Lake, Chairman Ward directed the secretary to follow standard procedure for the submission of a GML 239 referral to Syracuse Onondaga County Planning Assn.

Acknowledgement of the County’s determination will be on the agenda for November’s meeting.

The public hearing remains open.

 

Public Hearing – 204 Brow Street

Chairman Ward opened the public hearing on the application of Clifford Ivers, as contractual buyer, for a variance to §136-56A (1) of the code of the Village of Liverpool, allowing a healthcare practitioner to operate an in-home occupation without being required to reside at the property located at 204 Brow Street, designated as Tax Map # 005.-10-07.0.

Following the presentation by the applicant, Chairman Ward coordinated the offering of verbal commentary in regard to this project.

Because this parcel is located within 500’ of Onondaga Lake, Chairman Ward directed the secretary to follow standard procedure for the submission of a GML 239 referral to Syracuse Onondaga County Planning Assn.

Acknowledgement of the County’s determination will be on the agenda for November’s meeting.

The public hearing remains open.

 

Discussion

Mr Romano led the Board in a continuing examination of existing Village of Liverpool willow sheds. Conversation will continue at the next meeting.
