Village of Liverpool May 27, 2008
A regular meeting of the
Village of Liverpool Planning Board was held on Monday, May 27, 2008 at
7:00 PM in the meeting room of the Village Hall, 310 Sycamore Street,
Liverpool, NY Chairman Ostuni called the meeting to order.
Approval of minutes –April 28, 2008
Motion was made by Tom Tartaglia, seconded by Peter Osborne, to approve the minutes of April 28, 2008 as corrected. Motion Passed.
Old business: Continued hearing on the application from J.T. Properties LLC for property located at 408 Oswego Street, tax map # 003-09-28 for site plan approval to construct a 6905 square feet building for Colonial Laundromat plus commercial tenant space on vacant lot.
Peter Crissey, Crissey Architectural Group, appeared before the Board, representing Jerry and Tim O’Connell, owners of the property located at 408 Oswego Street, tax map # 003-09-28.
The proposed plan is to construct a 6905 square foot building for Colonial Laundromat plus commercial tenant space on a lot that is currently vacant. The new building will be constructed on the northerly property line.
Peter Crissey stated that the applicants met with DOT regarding the ingress and egress and based on their discussions, the applicant has moved the ingress and egress to the south. The applicant resubmitted this design to NYSDOT and it has met with their approval.
The applicant proposes some type of vegetation around the proposed sign. The applicant has proposed planting along the front of the lot to define and separate the parking lot from the sidewalk. CHA will review the plan.
Planning board member, Peter Osborne, asked why the proposed structure is not on the street line. Peter Crissey commented that, in order to have the building on the street line it would have to be a smaller structure and that it would not be economically feasible. Also, parking would have to be on the back side of the building, which is not desirable.
The planning board asked about the visibility of the galvanized dryer vents from the north side of the building. The applicant stated that they could screen the vents OR paint them to match the roof of the building.
Peter Osborne stated that he would like to see a more architectural theme on the front of the parcel and that the galvanized vents need to be hidden.
Tom Tartaglia agreed with Peter Osborne regarding these two issues that need mitigation.
Jerry O’Connell, one of the owners of the parcel, stated that they could put landscape stone or pavers on the front of the property.
Joe Ostuni, Chairman, read the Onondaga County Planning Board’s recommendation, which states in part:” Now therefore be it resolved that he Onondaga county Planning Board recommends the following modifications to the proposed action prior to local board approval of the proposed action:
1. The applicant must complete a traffic study to meet NYS DOT requirements and submit it to the NYSDOT for approval. 2. The applicant must provide an engineering study to verify to the NYSDOT that the proposed development would not create additional storm water runoff into the state’s drainage system. 3. A lighting plan must be developed to ensure that no glare or spillover is allowed onto adjacent properties and the state right of way and the plan must be approved by the Village Engineer.”
The applicant has complied with the modifications. The applicant met with NYSDOT and as a result of that meeting, the applicant has added a catch basin.
Chairman Ostuni stated that economic development is very important for the Village of Liverpool and that this plan is very important for economic development in this area.
Chairman Ostuni asked for a motion on the application of J.T. Properties LLC for property located at 408 Oswego Street, tax map # 003-09-28 for site plan approval to construct a 6905 square foot building for Colonial Laundromat.
Motion was made by James Taft, seconded by Tom Tartaglia, to approve the site plan for J.T. Properties LLC for property located at 408 Oswego Street, based on a map by Crissey Architectural Group, dated 4/28/08 and revised 5/22/08, job # 08057 ,sheet number G-1 and G-2, contingent upon: · legal and engineering · screening or paint on the galvanized vents to match the roof · an architectural element or landscape design parallel to the sidewalk on the north side of the driveway that meets with the Village engineer’s approval · the plan must be consistent with the master plan, recently adopted by the Village of Liverpool.
Discussion: Peter Osborne would like to see a brick column (three columns) with a fence in the front of the building and he does not want the dryer vents to be visible from the road.
Jerry O’Connell, applicant and owner of the property, stated that the brick column would be too expensive and that they would add landscaping to the front.

Update on LaValles for parking at 209 Second Street for business located at 318 First Street
At the April 28, 2008 planning board meeting, the board made the following motion:
Motion was made by Tom Tartaglia, seconded by Yvette Hewitt, to approve the revised site plan for Champion FX, LLC for property located at 314 and 318 First Street, based on a map by Ianuzi & Romans, dated March 7, 2008, file # 3315.001 and based on the following conditions and contingent upon these items being mitigated::
There will be no pre-exam events at this location The applicant will pursue the use of 10 spaces at 209 Second Street and show proof of the secured parking spaces by the next planning board meeting, scheduled for May. The applicant will connect the parking area at 209 Second Street and 314 First Street with a ramp. The applicant will need an additional 17 spaces on street (which complies with code) Designated parking areas will be part of the agreement with students, outlining the areas that are designated for patron parking. A notice will be given to patrons that there will be no backing out unto First Street.
Approval is based upon the applicant providing proof of parking at 209 Second Street within two weeks of this meeting. If the applicant is not in compliance with all above items, the site plan can be withdrawn.
Based on this motion, the applicant presented the letter from Fargo Properties, dated May 1, 2008, leasing 10 spaces in the south section of the parking lot at 209 Second Street to LaValles Karate Studio. This completes the application approval
New business: Application from JGB Properties, LLC for site plan approval for property located at 403 First Street, tax map # 005-10-08 to construct five garages to serve the new condominium units that will be built within the existing three story brick building. Rod Ives, Napierala Consulting, appeared before the Board to present proposed plans for property located at 403 First Street, tax map 3 005-10-08 to construct five garages to serve the new condominium units that will be built within the existing three story brick building.
The curb cut on Brow Street will be closed off, with a new curb cut being constructed on Tulip Street... Parking requirements, per Village code, is 22 spaces for this building. The proposed plan shows 5 parking spaces in the garages, one for each unit. Fifteen spaces in the parking lot, which do not meet code requirements. According to Section 136-5 of the Village code, parking spaces must be 9 feet wide. The applicant is proposing 8 parking spaces that are 8 feet wide. The applicant will be requesting a variance to this parking code requirement.
Zoning code permits up to half of the required spaces on street, within 200 feet of the structure. Five on street spaces are available in front of the building. The applicant needs 9 on street parking spaces in total.
Lighting will be on the building and the applicant will provide a photometric lighting plan.
On the east side of the proposed parking lot, a 5 foot landscaped buffer is needed.
Motion was made by Peter Osborne, seconded by Tom Tartaglia, to refer the site plan to the Village Engineer for their review and input, specifically in regards to storm water runoff. Motion Passed.
Motion was made to declare the Village of Liverpool as lead agency for the application of JGB Properties LLC for property located at 403 First Street, tax map # 005-10-08 for site plan approval. Motion Passed.
Motion was made by Tom Tartaglia, seconded by Peter Osborne, to declare this action for SEQR purposes an unlisted action. Motion Passed.
Motion was made by Yvette Hewitt, seconded by Tom Tartaglia, to declare this action a negative declaration for SEQR purposes. Motion Passed.
Motion was made by Tom Tartaglia, seconded by Peter Osborne, to refer this application to Onondaga County Planning Board for their review and recommendation. Motion Passed.
The public hearing will be continued at the June 2008 meeting.
