Board of Trustees  Meeting

 A regular meeting of the Village of Liverpool Board of Trustees was held on Monday, May 18, 2009, at 7:00 PM at 310 Sycamore Street, Liverpool, and New York

Mayor Ward called the meeting to order at 7:00 PM and all those present joined in the pledge of allegiance.

 

 

Richard Ward, Zoning Board Chairman asked to speak to the board. He stated that due to a clerical error a public notice for a zoning board application was mis-represented. The public notice needs to be re-advertized. Chairman Ward asked that the Village pay for the new advertisement, due to the fact that it was not the applicant’s error.

 

Motion was made by Trustee Hebert, seconded by Trustee Kochan, to pay for the public hearing notice regarding a zoning board application that was mis-represented. Motion Passed.

 

Liverpool Library Presentation

Jean Polly and Dorothy Morgan presented the budget for the Liverpool Library which will be voted on this week.  They presented new items that are available at the library: play aways, large print books, classics, recorded lectures, blue ray discs, bifocal kits, learning backpacks etc.

 

The proposed budget has a 0% tax increase.

 

The Mayor thanked Jean and Dorothy for coming to this board meeting and encouraged everyone to vote.

 

Public hearing LL C- 2009 to amend Section 129-8 to the following:“ The parking of a vehicle is hereby

Prohibited on all highways within this village between 12:00 AM- 8:00AM between November 1st and April 

15th, with the exception of the Village Business District which will be between the hours of 2:00 AM- 8:00

AM.”

 

Motion was made by Trustee Rosier, seconded by Trustee Kochan, to open the public hearing. Motion Passed.

 

There were no questions or comments.

 

Motion was made by Trustee Rosier, seconded by Trustee Kochan, to close the public hearing. Motion Passed.

 

Motion was made by Trustee Kochan, seconded by Trustee Rosier, to pass a resolution that for SEQR purposes, this proposed local law is an unlisted action and determined that the action will have no significant adverse impact on the environment. Motion Passed.                                     

 

Motion was made by Trustee Kochan, seconded by Trustee Rosier, to adopt Local Law # 2- 2009 to amend Section 129-8 to the following:

The parking of a vehicle is hereby Prohibited on all highways within this village between 12:00 AM- 8:00AM between November 1st and April  15th, with the exception of the Village Business District which will be between the hours of 2:00 AM- 8:00 AM.” Motion Passed.

 

Trustee Hebert was opposed to this motion and voted against Local Law # 2- 2009 .

 

 

Public hearing LL D- 2009 to add a Section “ Developers Fees” to the Village of Liverpool code.

Motion was made by Trustee Kochan, seconded by Trustee Hebert, to open the public hearing on LL D- 2009 to add a section “ Developers Fees” to the Village of Liverpool code. Motion Passed.

 

There were no questions or comments.

 

Motion was made by Trustee Hebert, seconded by Trustee Kochan, to close the public hearing on LL D-2009 . This will be on the agenda for June.

 

Public hearing LL B- 2009 to amend Section 83-17 “ Outdoor Burning.”

Motion was made by Trustee Kochan, seconded by Trustee Rosier, to adjourn the public hearing to June 15th at 7:01 PM. Motion Passed.

 

Public hearing for revocable license agreement 417 First Street to permit the installation of a

portion of a driveway on Village Property.

 

Motion was made by Trustee Kochan, seconded by Trustee Rosier, to open the public hearing on the request for a revocable license agreement at 417 First Street to permit the installation of a portion of a driveway on Village Property. Motion Passed.

 

The applicant, Robert Bradt, was present to answer any questions. He stated that he is recoating the portion of his driveway that is on Village property and would like to add to his driveway area on his private property.

 

The Village board requested that the Codes department contact Mr. Bradt.

 

Hearing no questions, a motion was made by Trustee Rosier, seconded by Trustee Kochan, to close the public hearing. Motion Passed. This will be on June Agenda

 

Police STATS

STATS for the police department for April were as follows:

324 Traffic tickets issued

23 DWI Arrests

9 Accidents investigated

0 parking tickets issued

462 Residential property checks

312 complaints

 

 

 

 

DPW     Monthly Report

Trustee Rosier presented the monthly report from the DPW department.

 

Motion was made by Trustee Rosier, seconded by Trustee White to approve the purchase of a Riding Mower for use in the cemetery from this year’s budget. Motion Passed.

 

Stomp out Hunger

The village board discussed a request to use Johnson Park on July 26th for a “Stomp out Hunger” event. If the applicant wants to pursue this event, he will return to the Village board at a future date.

 

Yard Waste Pick up – change

The Village board discussed changing the day for yard waste pick up. It was decided that the Village would do a “test” run starting on June 15th ( Monday) to pick up yard waste. Yard Waste will be picked up on the 1st and 3rd Monday of each month.

 

Motion was made by Trustee White, seconded by Trustee Hebert, to approve the change to the yard waste pick up day to the 1st and 3rd Monday of each month, starting June 15th for a trail period. Motion Passed.

 

Sewer Project- Fourth Street-update

Rich Deguida, reviewed the current contract with JJ Lane for the 4th Street Project. He reviewed some possible additions and deletions.  He requested additional construction observation time in the amount of $9747.50 The board discussed the estimated value of additional driveway replacement.

 

Rich will get back to the board with more accurate prices for the work in the driveways.

 

Approve 2009-2010 Intermunicipality Agreement between the Village of Liverpool and Liverpool Central School District for preventive maintenance and repair work in Village vehicles and to authorize the Mayor to sign the agreement.     

 

Motion was made by Trustee Rosier, seconded by Trustee White, to approve the 2009-2010

Use of Municipay for credit cards

On hold until further review.

 

Call public hearing – Verizon – on hold

 

Motion was made by Trustee Rosier, seconded by Trustee Kochan, to grant the request from Regional Medical Services to conduct a flu clinic at a date to be determined and to authorize Mayor Ward to sign the agreement. Motion Passed.

 

Motion was made by Trustee Hebert, seconded by Trustee Kochan, to grant permission to the Historical Association of Greater Liverpool to scrape and paint the Willow Museum at no cost to the Village of Liverpool. Motion Passed.

 

Motion was made by Trustee White, seconded by Trustee Kochan, to grant permission to Alicia Heneka to hold a block party on June 6th, 2009 and to grant permission to close Melvin Avenue on that date, provided that the event hours are reviewed by the Chief of Police and that the Chief of Police reviews and approves. Motion Passed.

 

Motion was made by Trustee Rosier, seconded by Trustee Hebert, to authorize the payment of $1.725 to CNY Regional Planning and Development board for installment number one. Motion Passed.

 

Financial Updates were presented to the Board of Trustees for their review.

YOU ARE FURTHER COMMANDED to file the tax roll and warrant in your office on or before the thirty-first day of October 2009 and to deliver to the Board of Trustees at the same time an account of the taxes remaining due and unpaid; describing each parcel or real property upon which taxes are unpaid, showing the person or persons to whom the parcel is assessed and showing which taxes are unpaid, showing the person or persons to whom the parcel is assessed and showing as to each parcel the amount of tax unpaid.

 

Approve abstracts

Motion was made by Trustee Hebert, seconded by Trustee Kochan, to approve the following abstracts:

General Fund , claim # 623-685 in the amount of $147,623.77; Sewer fund ,claim # G116 in the amount of $ 50395.60; HG fund claim # HG26,27 and 28 in the amount of $89,735.62 and HN Johnson Park claim # 38 in the amount of $ 1117.00. Motion Passed.

 

Minutes

Motion was made by Trustee Hebert, seconded by Trustee Kochan, to approve the minutes of

April 6th, April 13 and April 22, 2009 . Motion Passed.

 

 

Executive session

Motion was made by Trustee Hebert, seconded by Trustee White, to enter into executive session for the purpose of contract negations. Motion Passed.

 

No action was taken during executive session.

 

Adjournment

Motion was made by Trustee Hebert, seconded by Trustee White, to adjourn the meeting. Motion Passed. Meeting was adjourned at 10:00 PM.
