A regular
meeting of the Village of Liverpool Board of Trustees was held on Tuesday,

Mayor Ward called the meeting to order and all those present joined in the pledge of allegiance. Swearing in Chief William J. Becker Acting Judge George Alessio, swore in Chief Becker. Chief Becker’s wife and daughter were standing along his side during the ceremony. Officers from the Liverpool Police Department, Camillus Police Department and Manlius Police Department were present for the ceremony. Mayor Ward thanked Acting Chief Burg for his dedication during this time. Acting Chief Burg introduced the Liverpool Police Department and Chief Becker introduced the other members of the police force from Camillus and Manlius. All officers present congratulated Chief Becker. Presentation of Plaque – Judge Harding Mayor Ward presented a plaque to Judge Harding honoring his 37 years of service to the Village of Liverpool as Justice. Judge Harding thanked everyone present. Public hearing on the adoption of LL # 1- 2008 Amending chapter 24, Officers and Employees of the Village of Liverpool, as amended to add a new article “Residency of Village Justice.” Mayor Ward explained the present law and the proposed law and then asked for a motion to open the public hearing. Motion was made by Trustee Hebert, seconded by Trustee White, to open the public hearing for LL # 1- 2008 amending chapter 24, Officers and Employees of the Village of Liverpool, as amended to add a new article “Residency of Village Justice.” Motion Passed. Mayor Ward asked for any input and the following residents asked to speak : Anthony LaValle, 101 Tulip Street, presented a petition with 55 signatures on it opposing changing the existing law to allow a non-resident to become Village Justice. He feels that there is no need to change the law. He stated that there are qualified people, living in the Village, that could fill the position. Attorney Mark Grobosky explained that in a Village, with a population of less than 3,000, the Village can look outside the Village limits. To do so, the present law would need to be changed. Attorney Grobosky explained that the proposed law does not take any rights away from Village residents but expands their rights. Joe Ostuni, Chair of Republican Committee and Village resident, stated the next Village election is June 17, 2008 and that the Republican Caucus will be held sometime from April 22- 29, date to be determined. He stated that changing the law will open the pool of candidates. Dick Ward, 309 Fourth Street, stated that if the law were changed to allow a non- resident to be Judge, the Mayor could appoint a non resident to fill the position. However, that appointment would only run until June election. At that time, Village residents will vote for Judge. Dick Ward feels that LL # ! does not affect the rights of residents. Loriane Henning, Village resident, felt that the residency of the Village Justice should stay in the Village. Brett , First Street resident, stated that there are enough candidates in the Village for the position of Village Justice. Dave Lyons, Village resident, stated that he was concerned and stated that if a candidate wants the position of Village Justice, they should move into the Village. Jon Zappola, supported the existing law – keep the residency requirement for the position of Judge. Tony LaValle, 101 First Street, stated that when a non- resident judge makes a decision, it affects the Village residents. Mark Grobosky, Attorney for Village of Liverpool, stated that a Judge is sworn to uphold the law and must apply the law. A non –resident judge would not apply the law differently. James Taft, 301 Sycamore Street, asked why the Village would change the law, as the Village election is in June . He asked why the acting Judge could not keep acting. Tom LaValle, 525 First Street, asked how many people the Mayor sought out for the position and who they were. He stated that a Village Justice would look out more for the residents that a non- village Justice. Aaron Arnold, attorney and Village resident, stated that it does matter who you have as judge. The Community deserves a judge to be a resident. He stated that we need to preserve the position of Village Justice. Hearing no more questions, Mayor Ward asked for a motion to close the public hearing and a vote on LL #1- 2008 amending Chapter 24, Officers and Employees of the Village of Liverpool, as amended to add a new article “Residency of Village Justice.” Motion Passed. Motion was made by Trustee Hebert, seconded by Trustee Kochan, to close the public hearing on LL #1- 2008 amending Chapter 24, Officers and Employees of the Village of Liverpool, as amended to add a new article “Residency of Village Justice.” Motion Passed. Motion was made by Trustee Kochan, seconded by Trustee Rosier, to table the decision until the February meeting on LL #1- 2008 amending Chapter 24, Officers and Employees of the Village of Liverpool, as amended to add a new article “Residency of Village Justice.” Motion Passed. Public hearing on the adoption of LL2 – 2008 Chapter 136, specifically section 136-70 “ Signs allowed without a permit” and section 136-71 “Signs requiring a permit.” Motion was made by Trustee Kochan, seconded by Trustee Hebert, to open the public hearing on the adoption of LL2 – 2008 Chapter 136, specifically section 136-70 “ Signs allowed without a permit” and section 136-71 “Signs requiring a permit.” Motion Passed. Mayor Ward asked for any comments and hearing none, asked for a motion to close the public hearing. Motion Passed. Motion was made by Trustee Kochan, seconded by Trustee Hebert, to close the public hearing on the adoption of LL2 – 2008 Chapter 136, specifically section 136-70 “ Signs allowed without a permit” and section 136-71 “Signs requiring a permit.”. Motion Passed. Motion was made by Trustee Kochan, seconded by Trustee Hebert, to adopt LL # 2- 2008 Chapter 136, specifically section 136-70 “ Signs allowed without a permit” and section 136-71 “Signs requiring a permit.”. Motion Passed. Residents wishing to speak Jon Zappola, First Street resident, asked the Village Board if there were any plans to open a senior housing project similar to the House at 807. He stated that there are empty stores that could be renovated. At this time, there are no plans in progress.

Monthly report DPW/Park requests Trustee Rosier gave the following report for the monthly DPW report: UFPO’s- five Sewer Maintenance calls- fourteen house calls were handled for the county. Park Requests Motion was made by Trustee Rosier, seconded by Trustee Hebert, to approve the use of Johnson Park for the Easter Egg Hunt on March 22, 2008 at 9:00 AM. Motion Passed. Sign Request Motion was made by Trustee Rosier, seconded by Trustee Kochan, to approve the request from the Liverpool Syracuse Masons to advertise the Easter Egg Hunt on March 22, 2008 on the Village sign, starting on March 15, 2008. Motion Passed. Cooperative Municipal Agreement – Town of Salina and Village of Liverpool Motion was made by Trustee Kochan, seconded by Trustee Hebert, to approve the Cooperative Municipal Agreement between the Village of Liverpool and the Town of Salina for storage of road salt. Motion Passed. Meeting with Town of Salina Supervisor Mayor Ward met with Mark Nicotra, Salina Supervisor to talk about a joint meeting between the Village and the Town of Salina. This will be scheduled in the very near future. MS4 The Village of Liverpool will be working with the Town of Salina on MS4 requirements. House at 807- Demo of Garage The garage at 807 cannot be demolished until the abstetos removal is complete. Bill Asmus will be asked to get three quotes for the removal and report to the Board at the next meeting. Roof – Village Hall Motion was made by Trustee Rosier, seconded by Trustee White, to go to bid for engineering services for the Village Hall Roof. Motion Passed. LCSD Meeting Trustee Kochan reported to the Board and public that he met with LCSD to discuss their upcoming proposed construction plans for their schools. Disability Exemptions for Village Tax Will be discussed at February meeting. Veterans Gravesites Will be discussed at February meeting. Sewer clean outs Attorney Grobosky will comprise a letter to homeowners stating that the Village of Liverpool cannot go onto private property if there is a problem with their sewer laterals. Johnson Park Development Corporation Mark will look into – February agenda EWA Construction Observation CHA This payment is listed on the capital projects fund abstract for the month of January.
Financial Report Updates Clerk Sims distributed the Treasurer’s Report and the Monthly report to all board members for their review. Budget process The budget process will begin the first week of February. All board members and department heads received the schedule. Approval Abstracts Motion was made by Trustee Hebert, seconded by Trustee Kochan, to approve the following abstracts:
General Fund, voucher # 408-479 in the amount of $91,997.33; TA account voucher # TA01-Ta04 $2,000; Misc Special revenue CM 14 $2146.50; Sewer fund G106, $17,152.50 and HG Capital Sewer Fund HG04-HG05 in the amount of $25,818.25. Motion Passed.
Approve transfers Motion was made by Trustee Hebert, seconded by Trustee Kochan, to approve the following transfers:

Approve minutes – December 17, 2007 and January 14, 2008 Motion was made by Trustee Hebert, seconded by Trustee Kochan, to approve the minutes of December 17, 2007 and January 14, 2008. Motion Passed. Executive Session Motion was made by Trustee Hebert, seconded by Trustee Kochan, to move into executive session for the purpose of a personnel matter. Motion Passed. Motion was made by Trustee White, seconded by Trustee Hebert, to move out of executive session. Motion Passed. Motion was made by Trustee White, seconded by Trustee Hebert, to return to regular session. Motion Passed. Change February meeting Motion was made by Trustee White, seconded by Trustee Hebert, to change the meeting date from February 18th to February 11, 2008, due to the holiday. Motion Passed. Adjournment Motion was made by Trustee Kochan, seconded by Trustee Hebert, to adjourn the meeting. Meeting was adjourned at 9:12 PM. Motion Passed.
