General Rules for the Cemetery |
 |
All lots are held in accordance with provisions of
§1501 of the Not-for-Profit Corporation Law of the State of
New York, and of all acts amending the same.
|
 |
The Village of
Liverpool Board of Trustees reserves the right to remove, after due
notice to the lot owner, any embellishment, effigy, or inscription
on a grave which, in the opinion of the majority of the Board, is
unsightly or dangerous.
|
 |
Heavy trucking or
other vehicular traffic shall be refused entrance to the cemetery,
when in the opinion of the Superintendent of Public Works,
impairment to the roads and driveways may result.
|
 |
All persons shall be
allowed access to the cemetery during daylight hours, observing the
rules which are in effect and the propriety due the cemetery.
|
 |
No lot owner shall
allow an interment to be made upon their lot except by direct
arrangement with the Village of Liverpool. No transfer or assignment
of any lot or interest therein will be valid without the consent in
writing from the Village of Liverpool. No disinterment or removal
from a vault will be allowed without permission from the Village.

 |
Wooden benches and
wooden or artificial markers are strictly forbidden.
|
 |
All work done in the
cemetery shall be done by cemetery employees under the control of
the Superintendent of Public Works.
|
 |
No dogs are allowed
in the cemetery (on or off leash).
|
 |
All terrain vehicles
are prohibited.
|
 |
Games, parties, and
consumption of alcoholic beverages are prohibited. |
|
|
Lots |
 |
The full purchase
price must be paid before a deed will be given or a burial allowed
on any lot.
|
 |
No enclosure of lots
will be allowed but simple corner posts of cut stone may be placed
to designate corners or angles of any lot. These corner posts are
not to project above the surface of the ground.

 |
The price of all
lots includes an amount for permanent maintenance. A portion of the
price of each lot is set aside by the Village of Liverpool in
a Cemetery Fund for permanent maintenance. The income from this fund
will be used; first for keeping lots properly graded, seeded, and
mowed; and secondly for the general improvement and beautification
of the cemetery grounds.

This fund does not
provide for the special care of headstones, monuments, trees, shrubs
and flowers nor for the watering of grass and flowers. Information
may be obtained from the Superintendent of Public Works regarding
the cost of any special work.

No sale, transfer,
or assignment of any lot or part of any lot will be valid without
written consent of the Village Board of Trustees. The record of such
a sale or transfer must be made in the records of the Cemetery. No
person will be recognized as the owner or part owner of a lot unless
his or her name appears upon the records of the cemetery as such
owner or owners. The joint ownership of lots is not recommended, but
where such ownership is deemed necessary it is advised that an
agreement be made between the joint owners as to the portion of the
lot so owned and the use to be made of it by each party.

Upon the death of a
lot owner, heirs or devisees should record in the office of the
cemetery the name of the person whom they designate to act as the
lot owner. If this is not done, the cemetery will designate one of
their number, as provided by law. |

|
Internments |
 |
No interment shall
be allowed without a permit.
|
 |
The Village of
Liverpool requires notice of at least twelve working hours in
advance of interments. The Village of Liverpool cannot accept
responsibility for the location of a grave to be opened when the
order is given over the telephone. If there is any question
regarding the location, it is recommended that someone in the family
visit the grave together with a representative of the Village of
Liverpool.

No graves will be
reopened for inspection except for official investigation.
|
 |
Lot owners are
prohibited from allowing interments to be made on their lots for
compensation.
|
 |
Interments in a
grave are restricted to those entitled to burial therein according
to the terms of §1512(c) of the Not-for-Profit Corporation Law.
Permission for burial of those not entitled to burial according to
the said Section must be filed with the Village of Liverpool Board
of Trustees by the grave owner.

Disinterments will
be allowed, provided the provisions of §1510 (c) of the
Not-for-Profit Corporation Law are complied with.
|
 |
Interments on
Saturdays, Sundays, and Holidays will be governed by Cemetery
Directives 201.8 and 201.12.
|
 |
Only one interment
may be made in a grave. However two (2) cremated remains or an
infant may be interred in an occupied grave.
|
 |
Cremated remains
will not be permitted to be scattered in any part of the cemetery.
|
 |
Concrete vaults or
concrete grave liners will be required for interments in all graves
purchased on or after January 1, 1985, in accordance with the
provisions of Cemetery Board Directive 201.6.
|
 |
While a funeral or
interment is being conducted, all nearby work of any description
shall cease.
|
 |
Graves may not be
opened between October and April when frost and weather conditions
warrant such refusal. |
|
|
Floral
Decorations |
 |
The Village of
Liverpool reserves the right to remove all flowers, shrubs, trees,
wreaths, or other decorations from lots as soon as they become
unsightly.
|
 |
The Village of
Liverpool reserves the right to restrict the planting of shrubs and
trees and to remove any shrub or tree deemed dangerous to the
public, after due notice to the lot owner.
|
 |
The cemetery will
provide a list of approved plantings and correct placement.
|
 |
All lot owners are
responsible for the maintenance of all plantings.
|
 |
The placing of
marble chips, wire fences, glass blocks, glass jars, glass vases and
unpainted cans as receptacles for flowers (either artificial or
grown) on graves or plots is prohibited.
|
 |
Flowers, trees,
shrubs, flower pots, or other decorations are to be placed close to
the monument or marker in order to facilitate grass cutting and
trimming.
|
 |
The Village of
Liverpool will do everything possible to protect these floral
decorations, trees, and shrubs but cannot accept any responsibility
for them.
|
 |
All holiday
decorations will be removed after 30 days.
|
 |
A general cleanup of
the cemetery will begin April 1st and November 15th
of each year. Out-of-season decorations, dead plants and flowers,
empty containers, faded artificial flowers and debris will be
removed.

 |
Refuse, wilted
flowers, and decorations are to be placed in cans provided for this
purpose or removed from the cemetery grounds. |
|
|
Monuments and Markers |
 |
No vault shall be
built above ground without the permission of the Village of
Liverpool and then only in such location as they may approve.
|
 |
No mausoleum will be
approved for construction.
|
 |
No monuments or
markers shall be permitted which utilize colors other than those of
natural stone.
|
 |
All foundations will
be constructed by the Village of Liverpool Department of Public
Works.
|
 |
All work done in the
cemetery shall be done by Village of Liverpool employees under the
control of the Superintendent of Public Works.
|
 |
Only one monument or
one upright marker shall be permitted per grave. Both shall be set
in accordance with the general plan of the cemetery and shall
conform with said plan in size and material.
|
 |
The base of the
monuments and markers is restricted in size to dimensions which will
not cover more than 65% of the width of the grave/graves. Every
monument or marker shall be at least 6 inches in thickness and
restricted to 4 feet in height unless approved by the Village of
Liverpool Board of Trustees.

Inscriptions on and
placements of all monuments and markers must conform to section and
lot and the general plan of the cemetery.
|
 |
The bases of all
monuments and markers shall be finished true and level so as to fit
on foundations without wedging or sprawls.
|
 |
No monuments and
markers will be allowed to be delivered to the cemetery until the
foundation is installed and ready to receive the monument or marker.
|
 |
All monuments or
markers must be constructed of granite or bronze. |
|
|
Funerals |
 |
Funerals must be at
the cemetery by 3:00pm, in order that workmen will have sufficient
time to properly close the grave and remove equipment before the end
of the workday.

All funerals,
processions, and vehicles will be under the control of the
Superintendent of Public Works or his employees while in the
cemetery. |
